01. THE CONCEPT. INDEPENDENCE AND AUTONOMY
The this.is Referral Program allows local partners (the "Partners") to be rewarded for promoting our platform. The goal is to share the culture of Portugal through technology by recommending the download of the application and access to our digital audio guides.
Joining the program does not establish, under any circumstances, any agency, mandate, commercial representation, employment relationship, or corporate partnership between SENSORY FRONTAGE – LDA and the Partner.
The Partner acts as an independent promoter of a technological platform and is expressly forbidden from presenting themselves to third parties as a guide, tour operator, or travel agent on behalf of SENSORY FRONTAGE – LDA.
The partnership is established on a non-exclusive basis, maintaining the Partner's total freedom to promote other platforms.
02. HOW IT WORKS (REFERRAL CODE)
SENSORY FRONTAGE - LDA assigns the Partner a unique alphanumeric referral code (e.g., UBERLISBON10 or HOTELALFA26).
- User Benefit: By entering the code upon registration, the user receives an immediate benefit (e.g., discount or content offer).
- Partner Benefit: For each content sale (POI, Route, or Guide) made with their code, the Partner accumulates a Digital Acquisition Fee in their personal account.
The referral code is the exclusive property of SENSORY FRONTAGE – LDA, and its use is personal, non-transferable, and revocable at any time.
The commission is only due when the transaction is successfully completed on the platform, confirming the download and effective access to the content by the end user.
Self-referral is expressly prohibited; no commission is due for purchases made by the Partner themselves or direct family members through their referral code.
03. RESTRICTION ON TOURIST ACTIVITY
The Partner is not authorized to make reservations, sell monument tickets, organize groups, or sell travel "packs". Their function is limited to recommending the download of a mobile application.
The amount paid to the Partner is a Digital Acquisition Fee. For accounting purposes, this amount should be treated as "Advertising and Digital Marketing Services".
The Partner must inform the user that purchasing digital content does not grant the right to any physical accompaniment service, transportation, or local assistance.
04. PAYMENT CONDITIONS
A mandatory condition for payment is the presentation of a valid tax document with the corresponding economic activity code for Advertising or Marketing Services.
The Partner is solely responsible for fulfilling their tax and contributory obligations.
The redemption of the accumulated balance is only processed upon the Partner's request through the dashboard, provided the minimum amount of €20.00 (twenty euros) is reached.
To ensure the program's sustainability, credits in accounts without any registered sales for a period exceeding 12 months will automatically expire.
05. ETHICS, GOOD PRACTICES, AND IMMEDIATE TERMINATION
To protect the community's integrity, the Partner is not allowed to:
- Use the this.is logo on uniforms or vehicles suggesting an official connection to the company without express written permission;
- Collect physical money from users to "pay" for the app (payment is always made within the App);
- Promise priority access to monuments or museums through the use of the app.
The Partner may use the provided marketing materials but cannot register domains, social media profiles, or brands that could be confused with the official identity of SENSORY FRONTAGE – LDA.
Violation of any of these rules implies the immediate cancellation of the Partner account and the loss of any accumulated commissions.
06. DURATION, TERMINATION, AND CANCELLATION
Either party may terminate the partnership at any time, by written communication (e-mail) with a minimum notice of 30 (thirty) days.
SENSORY FRONTAGE, LDA reserves the right to terminate the partnership with immediate effect, without prior notice and with total loss of the accumulated balance, in cases of: Misconduct, False Promises, Spam/Abuse, or Violation of Obligations.
07. DATA PROTECTION AND CONFIDENTIALITY
The Partner acknowledges that access to the dashboard and the referral program does not grant them any right of access to end users' personal data (such as names, emails, or contacts), in compliance with the General Data Protection Regulation (GDPR).
It is strictly prohibited for the Partner to request or collect personal data from users on behalf of SENSORY FRONTAGE – LDA.
08. APPLICABLE LAW AND JURISDICTION
Any dispute, controversy, or claim arising from or related to these Policies will be governed by the laws of Portugal. The competent jurisdiction will be the District of Lisbon.
