REFERRAL POLICY

01. THE CONCEPT. INDEPENDENCE AND AUTONOMY

1.1. The this.is Referral Program allows local partners (the "Partners") to be rewarded for promoting our platform. The goal is to share Portuguese culture through technology, recommending the download of the application and access to our digital audio guides.

1.2. Joining the program does not, under any circumstances, establish any relationship of agency, mandate, commercial representation, employment relationship, or corporate partnership between SENSORY FRONTAGE – LDA and the Partner.

1.3. The Partner acts as an independent promoter of a technological platform, and is expressly prohibited from presenting himself/herself to third parties as a guide, tour operator or travel agent on behalf of SENSORY FRONTAGE – LDA.

1.4. The partnership is established on a non-exclusive basis, with the Partner retaining full freedom to promote other platforms.

02. HOW IT WORKS (REFERRAL CODE)

2.1. SENSORY FRONTAGE – LDA assigns the Partner a unique alphanumeric referral code (e.g., UBERLISBOA10 or HOTELALFA26).

  • Benefit for the User: By entering the code at registration, the user receives an immediate benefit (e.g., discount or a free piece of content).
  • Benefit for the Partner: For each sale of content (POI, Route or Guide) made using the code, the Partner accrues a Digital Referral Fee in his/her personal account.

2.2. The referral code is the exclusive property of SENSORY FRONTAGE – LDA, and its use is personal, non-transferable and revocable at any time.

2.3. The commission is only due when the transaction is successfully completed on the platform, confirming the download and effective access to the content by the end user.

2.4. The practice of "self-referral" is expressly prohibited, and no commission is due for purchases made by the Partner or direct family members (spouse or equivalent, descendants and ascendants) through his/her referral code.

03. RESTRICTIONS ON TOURIST ACTIVITY

3.1. The Partner is not authorised to make bookings, sell tickets to monuments, organise groups or sell travel "packs". His/her function is limited to recommending the download of a mobile application.

3.2. The amount paid to the Partner is a Digital Referral Fee. For accounting purposes, this amount must be treated as "Advertising and Digital Marketing Services", falling outside the scope of commissions for the sale of tourist services (Art. 2 of Decree-Law 108/2009).

3.3. The Partner must inform the user that the purchase of digital content does not grant any right to physical accompaniment, transport or local assistance.

04. PAYMENT CONDITIONS

4.1. It is a mandatory condition for payment that a valid tax document be issued (Invoice, Invoice-Receipt or Isolated Act) with the CAE (Economic Activity Code) corresponding to Advertising or Marketing Services.

4.2. The Partner is solely responsible for compliance with his/her tax and social-security obligations (VAT, Personal/Corporate Income Tax and Social Security).

4.3. The withdrawal of the accumulated balance is only processed upon request by the Partner through the dashboard, provided that the minimum amount of €20.00 (twenty euros) has been reached. For invoicing purposes, this amount is deemed to include all applicable taxes (in particular VAT, if due), with the net amount transferred depending on the Partner's tax status and any mandatory withholding taxes.

4.4. To ensure the sustainability of the program, credits in accounts with no recorded sale for a period exceeding 12 months will automatically expire.

4.5. Any discrepancy or error in the recording of a commission must be reported by the Partner within a maximum period of 30 (thirty) days after the transaction. After this period, the amounts recorded on the dashboard are considered consolidated and accepted by both parties.

05. ETHICS, BEST PRACTICES AND IMMEDIATE TERMINATION

5.1. To protect the integrity of the community, the Partner is not permitted to:

  • Use the this.is logo on uniforms or vehicles that suggest an official connection to the company, except with express written authorisation;
  • Collect physical cash from users as "payment" for the app (payment is always made within the App);
  • Promise priority access to monuments or museums through the use of the app.

5.2. The this.is brand is our greatest asset. The Partner may use the marketing materials provided, but may not register domains, social-media profiles or trademarks that could be confused with the official identity of SENSORY FRONTAGE – LDA.

5.3. The violation of any of these rules results in the immediate cancellation of the Partner account and the loss of any accumulated commissions, without prejudice to civil liability for damages to the brand.

06. DURATION, TERMINATION AND RESOLUTION

6.1. Either party may terminate the partnership at any time, by means of written communication (e-mail) with a minimum notice of 30 (thirty) days.

6.2. In the event of termination by SENSORY FRONTAGE – LDA, the Partner shall be entitled to withdraw the accumulated balance up to the effective date of termination.

6.3. SENSORY FRONTAGE, LDA reserves the right to terminate the partnership with immediate effect, without the need for prior notice and with the total loss of the accumulated balance, in the event of:

  • Misconduct: Use of the brand name for illegal, misleading activities or activities that harm the company's reputation;
  • False Promises: If the partner promises services that the application does not provide (e.g., physical accompaniment or free admission to museums);
  • Spam or Abuse: Massive publication of the code on coupon sites, forums, or social-media comments in an intrusive manner;
  • Breach of Obligations: If the partner identifies himself/herself to third parties as an employee, official guide, or legal representative of SENSORY FRONTAGE – LDA.

6.4. Upon termination of the partnership, for any reason, the Referral Code will be immediately deactivated. The former Partner must cease any and all use of the promotional materials and logos of SENSORY FRONTAGE – LDA.

07. DATA PROTECTION AND CONFIDENTIALITY

7.1. The Partner acknowledges that access to the dashboard and to the referral program does not grant him/her any right of access to the personal data of end users (such as names, e-mails or contacts), in compliance with the General Data Protection Regulation (GDPR).

7.2. The Partner is strictly prohibited from requesting or collecting personal data from users on behalf of SENSORY FRONTAGE – LDA. Any database of potential clients created by the Partner for promoting the code is the Partner's sole legal and technical responsibility.

7.3. The Partner is obliged to maintain absolute confidentiality regarding any commercial information, conversion metrics, marketing strategies, or specific financial conditions of the partnership that are not in the public domain.

7.4. Should the Partner become aware of any misuse of the platform or hacking attempt through his/her code, he/she must notify SENSORY FRONTAGE – LDA within a maximum period of 24 hours.

08. APPLICABLE LAW AND JURISDICTION

8.1. Any dispute, controversy or claim arising out of or relating to these Policies shall be governed by the laws of Portugal.

8.2. For the settlement of any litigation, the competent venue shall be the Judicial District of Lisbon.

8.3. SENSORY FRONTAGE – LDA reserves the right to alter the conditions of this Policy at any time, upon 15 days' prior notice published on the dashboard or sent by e-mail. The continued use of the code after this period constitutes full acceptance of the new conditions.
