TERMS AND CONDITIONS OF USE (T&C)

01. IDENTIFICATION OF THE SELLING ENTITY

1.1. The sale of the Service through this website is carried out by:

02. LEGAL NATURE AND EXCLUSION OF TOURIST ACTIVITY

2.1. SENSORY FRONTAGE – LDA is a technological platform dedicated exclusively to the editing, licensing and commercialisation of digital content (software, audio masters, texts and digital cartography).

2.2. The service provided by SENSORY FRONTAGE – LDA falls within the activity of content publishing and computer programming. The platform operates as a passive digital medium (equivalent to a georeferenced audiobook player), limited to providing a technological infrastructure for access to cultural content. SENSORY FRONTAGE – LDA is not a tourism animation operator, travel agency or tour guide.

2.3. For all legal purposes, SENSORY FRONTAGE – LDA expressly declares that:

  • It does not organise or commercialise events, excursions, guided tours, mandatory itineraries, nor does it control the length of stay at locations;
  • It does not establish departure or arrival times;
  • It does not provide transport, accommodation, interpreter guides or physical accompaniment;
  • It does not assume control or management of the physical route undertaken by the user;
  • It does not provide in-person assistance or accompaniment;
  • It bears no responsibility for the management of tourist flows or public safety;
  • It does not guarantee the safety of the physical route, which is the sole responsibility and free choice of the user, who consumes the audio content as he/she would a music playlist or podcast.

2.4. The content made available is of a strictly editorial and informative nature, equivalent to an audiobook or thematic podcast. The sequence of audio files on the platform is a suggestion for the organisation of digital files and is not a mandatory or guided tourist itinerary.

03. LEGAL CAPACITY (Minimum Age)

3.1. The User must be 18 years of age or older. By using the Services, the Client enters into a legally binding agreement.

3.2. The use of the Transaction Service is exclusive to the acquisition of licences for digital contents.

04. OBJECT AND LICENSING OF CONTENT

4.1. The product marketed consists of the temporary or permanent transmission of licences to access audio content and associated metadata (MP3 format or similar) containing historical, cultural and informative information.

4.2. The acquisition of the file grants the Client a personal, individual and non-transferable licence of use.

4.3. The use of these audios through loudspeakers or amplification systems in public spaces for groups, broadcasting, sharing on third-party platforms, or any commercial exploitation of the content without prior written authorisation is expressly prohibited.

4.4. Access to the content is based on the execution of files that, due to their technical configuration, activate the geolocation feature of the device. This activation constitutes a software interoperability requirement and cannot be considered an accompaniment or guide service.

05. EXCLUSION OF THE RIGHT OF WITHDRAWAL (Refunds)

5.1. By confirming the transaction, the User requests the immediate execution of the digital service.

5.2. Pursuant to Article 17, paragraph l) of Decree-Law No. 24/2014, the right of withdrawal (14-day right of repentance) does not apply to the supply of digital content not provided on a tangible medium, if performance has begun with the prior consent of the consumer.

5.3. By starting the download or streaming of the audio, the Client expressly acknowledges that he/she loses the right of withdrawal, given the immaterial and instant-consumption nature of the product, and there is no right to refunds after access to the content.

06. LIABILITY AND USER AUTONOMY

6.1. The User acknowledges that the application is a passive consultation tool. The decision to undertake any route, as well as the choice of route, is the sole responsibility of the User.

6.2. Use of the application presumes that the user explores the city in a fully independent and autonomous manner.

  • Road Safety: The user is solely responsible for his/her physical safety. Listening to the contents must be done in a way that does not compromise attention to road and pedestrian traffic. We recommend the use of only one earphone or reduced volume in areas of heavy traffic.
  • Itineraries: The suggested "Routes" are mere proposals for the organisation of content. The user is free to alter the route and must always respect local signage, access prohibitions and rules of civility.
  • Third-Party Access: SENSORY FRONTAGE – LDA does not guarantee access, opening hours or admission prices to museums, monuments or establishments mentioned in the audios, as these are managed by independent entities.

6.3. SENSORY FRONTAGE – LDA disclaims any liability for accidents, property damage or non-property damage, thefts or traffic interruptions that occur during the period in which the user is consuming the content.

6.4. SENSORY FRONTAGE – LDA does not guarantee that the content is updated in real time with regard to traffic changes, road works or closures of spaces, reinforcing that the user must act as an independent driver, unrelated to any group organisation.

6.5. The User is solely responsible for ensuring that he/she has the necessary equipment (smartphone, earphones and battery) in working order to access the content. SENSORY FRONTAGE – LDA is not responsible for the interruption of the experience due to failures in the user's hardware, battery discharge or physical damage to the devices during the route.

6.6. Access to the contents may be made via streaming or through prior download for offline consultation. All costs arising from the consumption of mobile data, roaming charges or internet plans with telecommunications operators are the sole and exclusive responsibility of the User.

07. LIMITATION OF TECHNICAL SUPPORT

7.1. The customer support of SENSORY FRONTAGE – LDA is limited exclusively to questions of technical support for the application (access problems, payments or downloads).

7.2. SENSORY FRONTAGE – LDA does not provide real-time navigation assistance, rescue or personalised geographical guidance, reinforcing the nature of the application as a pre-recorded informational medium; the user should resort to the city's official channels for such purposes.

08. LANGUAGES AND CONTENT

8.1. Although the software may suggest a language based on system settings, final responsibility for the selection and acquisition of the correct linguistic version of the content lies exclusively with the User at the time of registration. Once access to the content has begun in a particular language, there will be no exchange or refund for an error in selection.

8.2. Small variations in interpretation between translations are inherent to the cultural adaptation of scripts and do not give rise to a right of compensation or claim of error.

09. LICENCE OF USE AND INTELLECTUAL PROPERTY

9.1. All content made available (sound masters, narrations, scripts, photographs and software code) is the exclusive property of SENSORY FRONTAGE – LDA, protected by the Code of Copyright and Related Rights.

9.2. The acquisition of any content (POI, Route or Guide) grants the user a Digital Use Licence, personal and non-transferable, for strictly private and non-commercial purposes.

9.3. The use of the application by third parties for the exercise of tour-guide activities ("guide piracy"), as well as the public reproduction, extraction of files or modification of the software, is strictly prohibited and shall be considered abusive use of the licence, resulting in the immediate cancellation of the account without refund.

9.4. Any abusive use or violation of intellectual property shall be the subject of criminal and civil proceedings, with SENSORY FRONTAGE – LDA reserving the right to claim compensation for losses and damages.

9.5. SENSORY FRONTAGE – LDA implements standard security measures to protect the platform. However, the company cannot be held liable for damages resulting from computer attacks, third-party intrusions ("hacking") or viruses that may affect the User's device, except where gross negligence in the protection of data by SENSORY FRONTAGE – LDA has been proven.

10. PRICES, PAYMENT AND INVOICING

10.1. Prices are indicated in Euros (€) and include VAT at the applicable legal rate. SENSORY FRONTAGE – LDA reserves the right to change prices at any time, without prior notice, without affecting purchases already completed.

10.2. Payment is made in full at the time of purchase through the means made available on the platform (e.g., Credit Card, Apple Pay, Google Pay, MBWAY).

10.3. Payment processing is carried out by certified external gateways. SENSORY FRONTAGE – LDA does not store credit card data or users' banking access credentials.

10.4. The User accepts to receive the invoice in electronic format. In cases where the purchase is processed directly by SENSORY FRONTAGE – LDA, the invoice will be sent to the registered e-mail. For purchases made via In-App Purchase (Apple/Google), the receipt/invoice will be issued by the respective application store.

11. REFERRAL PROGRAM AND PARTNERSHIPS

11.1. SENSORY FRONTAGE – LDA may assign discount codes to authorised partners. These codes are for strictly promotional use.

11.2. The publication of partner codes on coupon discount sites or public forums without prior authorisation is prohibited. Abusive use will result in the cancellation of the code and of the accumulated balance.

11.3. Partners (drivers, hotels, etc.) are independent entities. SENSORY FRONTAGE – LDA has no employment relationship with them and is not responsible for statements or promises made by partners that do not appear in the App's official documentation.

11.4. For the purposes of calculating commissions, only sales where the code was correctly entered at the time of the transaction will be counted. There will be no retroactive attribution of commissions.

12. COLLECTION AND USE OF INFORMATION (GDPR Compliance)

12.1. By using the Transaction Services, the User acknowledges that SENSORY FRONTAGE – LDA will access and process his/her personal, financial and transactional data. This processing is necessary in order to:

  • 1. Perform the contractual relationship established in these T&C.
  • 2. Comply with our legal and security obligations.

12.2. The processing of this information is subject to our Privacy Policy and Cookies Policy.

13. CHANGES AND TERMINATION

13.1. SENSORY FRONTAGE – LDA reserves the right to modify these T&C, service features or publish new rules at any time.

  • 1. Notification: The User will be notified of substantial changes at least 15 days before their entry into force.
  • 2. Tacit Acceptance: Continued use of the Services after the entry into force of the changes constitutes acceptance of the new terms.
  • 3. Termination: If the User does not agree with the terms, he/she may terminate the relationship at any time by closing his/her account on the platform.

14. APPLICABLE LAW AND JURISDICTION

14.1. Any dispute, controversy or claim arising out of or relating to this Contract shall be governed by the laws of Portugal.

14.2. For the settlement of any litigation, the competent venue shall be the Judicial District of Lisbon.

15. DISPUTE RESOLUTION AND COMPLAINTS BOOK

15.1. In the event of a consumer dispute, the Client may resort to the competent Consumer Alternative Dispute Resolution (ADR) Entities.

  • ADR Entities: CACCL (Centre for Arbitration of Consumer Disputes of Lisbon).
  • Certified Extrajudicial Resolution: The User may also select a certified extrajudicial dispute-resolution body to resolve disputes related to This Is Portugal's decisions following a notification or complaint.
  • Electronic Complaints Book: The Client may access the Electronic Complaints Book at www.livroreclamacoes.pt

16. FINAL PROVISIONS (Severability)

16.1. If a court considers any part of this Contract unenforceable, the remaining provisions shall remain in full force and effect.

  • Non-Waiver: The fact that we do not take steps to enforce this Contract does not mean that we waive our right to enforce it.
  • Assignment: SENSORY FRONTAGE – LDA may assign this Contract to any of its affiliates and to any successor. The User may not assign this Contract to third parties.
